In-Depth Guide
Civil litigation in Cyprus encompasses the resolution of disputes between private parties through the court system. Whether you are pursuing a claim or defending against one, the process requires experienced advocates who understand the procedural rules, evidential requirements, and strategic considerations that determine the outcome of civil proceedings in Cyprus.
At Philippou Law Firm, our litigation team has extensive experience representing individuals and businesses in civil disputes before the Cyprus District Courts and the Supreme Court. We provide clear, practical advice from the earliest stages of a dispute and work to achieve the best possible outcome, whether through negotiation, settlement, or trial.
Our civil litigation practice covers a broad range of disputes, including:
Civil proceedings in Cyprus follow a structured process governed by the Civil Procedure Rules:
Before issuing proceedings, we send a formal pre-action letter to the opposing party setting out the claim and inviting resolution. This step is important both as a matter of good practice and because courts may take into account whether parties attempted to resolve the dispute before litigation.
If the dispute cannot be resolved, we file a claim form, supported by particulars of claim, at the appropriate District Court under the Civil Procedure Rules that came into force on 1 September 2023. The choice of court depends on the subject matter and the monetary value of the claim. Claims up to €100,000 are heard by a single District Court judge, while higher-value claims may be assigned to a senior judge.
After the claim form and particulars of claim are served, the defendant files a memorandum of appearance within 14 days and then a Defence (and any Counterclaim), within 28 days of that appearance. The claimant may file a Reply. These documents define the issues in dispute and frame the evidence that each party must produce at trial.
Before trial, either party may apply for interim orders including:
At trial, each party presents their evidence through witness testimony, documentary evidence, and (where necessary) expert evidence. The judge delivers a written judgment after hearing all evidence and submissions.
Once a judgment is obtained, we assist with enforcement through various mechanisms including attachment of assets, charging orders over property, and garnishee orders against third parties holding the debtor's funds.
In many civil disputes, urgent action is needed before a full trial can take place. We regularly obtain:
These applications are often made on an ex parte (without notice) basis and require careful preparation to satisfy the court that the remedy is justified.
Cyprus follows the general principle that the unsuccessful party pays a contribution towards the successful party's legal costs. However, the amount recoverable is based on court-approved scales and rarely covers the full cost of litigation. We provide detailed cost estimates at the outset and keep you informed of the financial implications at every stage.
Our civil litigation team combines deep knowledge of Cyprus procedural law with a pragmatic, results-oriented approach. We focus on achieving the most efficient resolution, whether that means aggressive pursuit of a claim, robust defence of an action, or negotiating a settlement that protects your interests.
We typically respond within 24 hours.

“Philippou & Associates have been excellent to work with during my company incorporation and residency visa processes. I worked directly with Panagiota Tsovili predominantly, who helped guide me through all the legal requirements and was excellent to deal with. I highly recommend her and Philippou Law for anyone seeking advice.”
