In-Depth Guide
Unpaid debts can cause serious cash flow problems for businesses and individuals alike. Whether you are owed money under a commercial contract, a loan agreement, an unpaid invoice, or a personal guarantee, prompt and effective debt recovery action is essential to protect your financial position.
At Philippou Law Firm, we provide a comprehensive debt recovery service, from the initial demand through to court proceedings and enforcement. We act for creditors of all sizes, from individuals pursuing personal debts to businesses recovering significant commercial obligations.
We begin by assessing the strength of your claim, the debtor's ability to pay, and the most effective recovery strategy. Key considerations include:
We send a formal legal demand letter to the debtor requiring payment within a specified period (typically 14-30 days). This letter sets out the basis of the claim, the amount owed, and the consequences of non-payment. In many cases, a well-drafted demand letter from a law firm is sufficient to prompt payment without the need for court proceedings.
If the debtor fails to respond or refuses to pay, we issue court proceedings. The type of proceedings depends on the nature of the debt:
Obtaining a court judgment is only the first step, the judgment must then be enforced against the debtor's assets. We use all available enforcement mechanisms:
For debts involving parties in different jurisdictions, we leverage:
For businesses dealing with repeated late payment or non-payment issues, we offer ongoing support including:
It is critical to act within the applicable limitation period. Under the Limitation of Actionable Rights Law (Law 66(I)/2012), the standard limitation period for debt claims is 6 years from the date the cause of action accrued (typically the date the debt became due and payable). Claims brought outside this period will be time-barred. If you have an outstanding debt, we recommend seeking legal advice promptly to protect your right to recover.
We typically respond within 24 hours.

“Philippou & Associates have been excellent to work with during my company incorporation and residency visa processes. I worked directly with Panagiota Tsovili predominantly, who helped guide me through all the legal requirements and was excellent to deal with. I highly recommend her and Philippou Law for anyone seeking advice.”
