3. Court Proceedings

4. Enforcement of Judgment

Obtaining a court judgment is only the first step, the judgment must then be enforced against the debtor's assets. We use all available enforcement mechanisms:

• Attachment and sale of movable property: The court bailiff seizes and sells the debtor's personal property to satisfy the judgment
• Garnishee orders: We apply for orders requiring third parties (typically banks) to pay money they hold on behalf of the debtor directly to the creditor
• Charging orders (Memo): We register a charge against the debtor's immovable property at the Land Registry, preventing sale or transfer until the debt is paid
• Examination of debtor: The court summons the debtor to disclose their assets, income, and financial position under oath
• Winding-up proceedings: For company debtors, we serve a statutory demand and, if unpaid, petition for the company's compulsory liquidation. This is a powerful enforcement tool as the threat of winding up often compels payment
