There is no reliable fixed timetable. An undefended matter may proceed more quickly than a defended case, but timing depends on service, the applicable procedure, the evidence, any related disputes, and the court's schedule.
A marriage celebrated abroad may be the subject of proceedings in Cyprus if the Family Court has jurisdiction. Under the domestic residence rule, the relevant residence period must exceed three continuous months; cross-border rules and document formalities must also be checked for the particular case.
In an uncontested divorce, the respondent does not oppose the dissolution or the grounds relied on; the statutory mutual-consent route has its own requirements. A divorce is contested when the dissolution or asserted grounds are opposed. Custody, property, and maintenance are separate ancillary proceedings, so disagreement about them does not by itself make the divorce petition contested.
The statutory notice procedure applies to specified religious marriages and requires notice to the competent religious leader. Filing can generally follow after six weeks unless the required certificate is issued earlier or an exception applies. Civil marriages do not use that religious-notice procedure.
A property claim is distinct from the divorce itself. Under Law 232/1991, a spouse may claim the part of the increase in the other spouse's property attributable to the claimant's contribution, including qualifying non-financial contribution. The statutory claim is generally time-barred three years after dissolution or annulment.

Divorce Procedure in Cyprus
Divorce proceedings in Cyprus are governed principally by the Family Courts Law of 1990 (23/1990), as amended, the Marriage Law of 2003 (104(I)/2003), and, where applicable, the statutory procedure for attempted reconciliation and spiritual dissolution. The Family Court determines applications for dissolution of civil and religious marriages within its jurisdiction.
The legal route depends on whether the relationship is a civil marriage, a religious marriage, or a civil union; those categories should not be assumed to use an identical dissolution procedure. Our team identifies the applicable route before preparing the filing.
Jurisdiction and Residency Requirements
Under the domestic jurisdictional rule, at least one party must have resided in the Republic for a continuous period exceeding three months. The competent court and any additional cross-border jurisdiction rules must be assessed from the parties' circumstances.
A marriage celebrated abroad may be the subject of proceedings in Cyprus if the Family Court has jurisdiction. The authentication, legalisation and translation requirements for a foreign marriage certificate depend on the issuing country, applicable convention or EU rule, and the court's filing requirements.
Civil Marriages vs Religious Marriages
The procedure differs depending on how you were married:
- Civil marriages, the religious-notice procedure does not apply. Civil unions follow their own statutory dissolution route and should be assessed separately.
- Religious marriages within the statutory notice regime, notice must first be served on the competent religious leader. Filing can generally follow once the statutory six-week period has elapsed, unless the reconciliation certificate is issued earlier or a statutory exception applies.
Grounds for Divorce
Cyprus law recognises several grounds for divorce. The most common are:
- Irretrievable breakdown of the marriage
- Separation for a continuous period of at least two years
- Infidelity and moral misconduct
- Abuse and domestic violence
Step-by-Step Divorce Process
- Preparing the application, the divorce petition states the legal grounds, describes the relevant facts, and includes supporting documents and evidence.
- Filing and service, the application is filed with the competent Family Court and formally served on the respondent, who must respond within the deadline that applies under the current procedural rules and the directions in the case.
- Uncontested proceedings, if the application is not defended, the matter may proceed more quickly, but no fixed completion time can be guaranteed.
- Contested proceedings, if the application is defended, the court gives directions and may hear evidence and witnesses. Timing depends on the issues, evidence and court schedule.
- Finality, the divorce decision becomes final after the applicable appeal period expires; if an appeal is filed, finality is deferred until the appeal is determined.
Divorce and Related Matters
A divorce application often involves interconnected issues that must be resolved alongside or after the dissolution:
- Property claims, a spouse who contributed to an increase in the other spouse's property may claim the part attributable to that contribution under Law 232/1991. Care of the family home and family members can count as contribution. The statutory claim is generally subject to a three-year limitation period after dissolution or annulment.
