Family proceedings depend on the legal route
Divorce jurisdiction, procedure and documents must be checked for the particular marriage and family. For the domestic jurisdictional route under the Family Courts Law 23/1990, the relevant residence period is a continuous period exceeding 3 months. A marriage celebrated abroad does not by itself prevent proceedings in Cyprus, but cross-border jurisdiction and document formalities require an individual assessment.
Civil and religious marriage procedures
Civil marriages do not use the religious-notice procedure. For religious marriages within the statutory notice regime, notice is served on the competent religious leader and filing can generally follow after 6 weeks, unless the required certificate is issued earlier or a statutory exception applies. Civil unions follow their own statutory dissolution route.
No fixed divorce timetable
There is no reliable fixed or guaranteed completion period. Timing depends on valid service, the Family Court's current timetable, evidence, procedural applications and whether the petition is defended. Property, maintenance and parental-responsibility proceedings are separate and have their own timelines.
Spousal property claims are contribution based
Under the Spouses' Property Relations Law 232/1991, a claim generally concerns one spouse's contribution to the increase in the other spouse's property. It is not an automatic equal division of all marital assets. The statutory rules, presumptions, exclusions, evidence and the general limitation period must be applied to the facts.
Children's best interests, needs and parental means
Under the Parents and Children Relations Law 216/1990, the Family Court regulates parental responsibility, residence and contact according to the child's best interests and the evidence. Joint exercise is possible in the circumstances allowed by law; divorce does not automatically produce a particular arrangement. Both parents contribute to a minor child's maintenance according to their means, assessed against the child's needs and circumstances.
