Child Custody in Cyprus

When parents separate or divorce, child custody (also called parental responsibility) becomes the most important issue. The Family Court's overriding concern is the best interests of the child.

Parental responsibility includes care of the child, administration of the child's property and representation in matters concerning the child. After divorce, annulment or separation, the Family Court regulates how parental responsibility is exercised.

Types of Custody

Joint Custody

The court may entrust parental responsibility to one parent or, where the parents agree and specify the child's residence, to both parents jointly. The court may also distribute aspects of responsibility between the parents. The controlling criterion is the child's best interests, not a presumption that one arrangement is preferred.

Shared Custody

Similar to joint custody, but the child spends approximately equal time living with each parent. This arrangement requires a high degree of cooperation between parents and is usually agreed by consent.

Sole Custody

The court may award sole custody to one parent when the other is deemed unable to provide adequate care, for example, due to substance abuse, domestic violence, or prolonged absence. The non-custodial parent typically retains contact and visitation rights, including overnight stays, unless the court determines this would be harmful to the child.

How the Family Court Decides

If parents cannot agree on custody, the Family Court considers:

• The child's emotional, educational, and psychological needs
• Each parent's ability to provide a stable and safe environment
• The child's existing routine and social connections
• The quality of the child's relationship with each parent
• The child's own wishes, depending on their age and maturity
• Reports from the Social Welfare Services, which assess the family situation and provide recommendations to the court

Parents may present an agreement to the Family Court. The court considers parental agreements but remains responsible for making an order that serves the child's best interests.

Contact and Visitation Rights

The parent with whom the child does not reside retains a right of personal communication with the child. If the parents disagree, the court determines how that right is exercised by reference to the child's best interests. Arrangements may address:

• Weekday and weekend visits
• Overnight stays
• Holiday and school break arrangements
• Phone and video contact

If a parent obstructs court-ordered contact, the other parent can apply to the court for enforcement.

Child Maintenance

Both parents are responsible for maintaining their minor child, each according to their means. Where the court sets maintenance, the amount is assessed by reference to the child's needs and the available financial means, including:

• The child's needs (education, healthcare, daily living costs)
• The paying parent's income and financial circumstances
• The child's living circumstances and welfare needs
• Any special needs of the child

The joint parental duty applies to a minor child. A court may continue maintenance after adulthood where special circumstances justify it, including disability or incapacity, National Guard service, or attendance at an educational institution or vocational school.

Spousal Maintenance

In addition to child maintenance, the court can order one spouse to pay maintenance to the other during or after divorce proceedings. Spousal maintenance is based on the financial needs and resources of both parties.

Enforcement of Court Orders

If a parent fails to comply with a custody, contact, or maintenance order, the other parent can apply to the Family Court for enforcement. Non-compliance with a court order is a serious matter and can result in penalties.
