Before issuing proceedings, we send a formal pre-action letter to the opposing party setting out the claim and inviting resolution. This step is important both as a matter of good practice and because courts may take into account whether parties attempted to resolve the dispute before litigation.
If the dispute cannot be resolved, we file a Writ of Summons or Originating Summons at the appropriate District Court. The choice of court depends on the subject matter and the monetary value of the claim. Claims up to €100,000 are heard by a single District Court judge, while higher-value claims may be assigned to a senior judge.
After the writ is served, the defendant files a Defence (and any Counterclaim). The claimant may file a Reply. These documents define the issues in dispute and frame the evidence that each party must produce at trial.
