Divorce in Cyprus is governed by the Family Law of 1990 (23/1990) as amended and the Marriage Law of 2003 (104(I)/2003). The Family Court has exclusive jurisdiction over divorce applications.

Jurisdiction and Residency Requirements

To file for divorce in Cyprus, at least one spouse must have been resident in Cyprus for a minimum of 3 months. The application is filed with the Family Court of the district where the applicant resides.

You can file for divorce in Cyprus even if you were married abroad. The foreign marriage certificate must be apostilled or legalised and translated into Greek or English.

Civil Marriages vs Religious Marriages

The procedure differs depending on how you were married:

• Civil marriages and civil unions — you can file directly with the Family Court. No prior notice or waiting period is required.
• Religious marriages — you must first notify the church and wait two months before filing the court application. This notice period gives the church an opportunity to offer reconciliation. Once the period lapses, you can proceed to court.

Grounds for Divorce

Cyprus law recognises several grounds for divorce. The most common are:

• Irretrievable breakdown of the marriage
• Separation for a continuous period of at least two years
• Infidelity and moral misconduct
• Abuse and domestic violence

Other grounds include mental illness lasting at least five years, bigamy, change of religion, and attempted murder of the spouse.

Step-by-Step Divorce Process

1. Preparing the application — the divorce petition states the legal grounds, describes the relevant facts, and includes supporting documents and evidence.
2. Filing and service — the application is filed with the Family Court and formally served on the respondent, who has 21 days to file an appearance and defence.
3. Uncontested divorce — if the respondent does not contest the application, the court can issue a divorce order relatively quickly, typically within 2 months.
4. Contested divorce — if the respondent files a defence, the court schedules a hearing. Both parties present evidence and witnesses. Contested cases typically take 6–12 months.
5. Final order — the divorce order becomes final 42 days after it is issued, unless either side appeals.
