What is passing off in Cyprus

Passing off is a legal claim available to owners of unregistered trademarks. It applies when someone deliberately or accidentally passes off their goods or services as those of another business.

To succeed in a passing-off claim, three elements must be proved:

1. Goodwill, the claimant's business has established goodwill and reputation associated with the mark
2. Misrepresentation, the defendant's use of a similar mark is likely to deceive consumers into thinking there is a connection
3. Damage, the claimant suffered or is likely to suffer damage as a result
