Marriage and Legal Obligations in Cyprus

A marriage in Cyprus — whether civil, religious, or a civil union — creates legal obligations covering property, finances, and parental responsibility. When a relationship breaks down, these obligations must be formally resolved through the Family Court.

Divorce Procedure in Cyprus

Divorce applications in Cyprus are governed by the Family Law of 1990 (23/1990) as amended and the Marriage Law of 2003 (104(I)/2003) as amended. The procedure differs depending on whether the marriage was civil or religious.

Jurisdiction

To file for divorce in Cyprus, at least one spouse must have been resident in Cyprus for at least 3 months. The application is filed with the Family Court of the district where the applicant resides.

Civil vs Religious Marriages

  • Civil marriages and civil unions — the applicant can file directly with the Family Court. No prior notice is required.
  • Religious marriages — you must first notify the church and wait two months before filing. This notice period allows the church to offer reconciliation. Once it lapses, you can proceed with the court application.

Grounds for Divorce

The most common grounds are:

  • Irretrievable breakdown of the marriage
  • Separation for a continuous period of at least two years
  • Moral misconduct and infidelity

Other grounds recognised by law include mental illness, bigamy, abuse, domestic violence, and change of religion.

The Divorce Process — Step by Step

  1. Filing the application — the divorce application states the grounds for divorce, describes the facts of the case, and includes supporting documents and evidence.
  2. Service on the respondent — the other spouse has 21 days to file an appearance and defence. If they do not respond, the applicant can obtain a divorce order by default.
  3. Contested hearing — if the respondent files a defence, the Family Court sets a hearing date and both sides present their case.
  4. Final order — the divorce order becomes final 42 days after it is issued, unless appealed.

An uncontested divorce can be finalised within approximately 2 months. A contested divorce typically takes 6–12 months, or longer if custody and property disputes are involved.

Matrimonial Property Division

Property division is often the most complex part of a divorce. Cyprus follows the principle of separate property ownership — each spouse retains ownership of property registered in their name. However, the Family Court can adjust this if one spouse contributed significantly to the other's property during the marriage.

The key principles are:

  • Jointly acquired property — property acquired jointly during the marriage is presumed to be jointly owned and divided equally, unless proven otherwise.
  • Contribution adjustment — the law presumes a one-third (1/3) contribution to the estate, which can be increased or decreased based on evidence. Contributions can be financial (income, savings) or non-financial (childcare, homemaking).
  • All asset types included — the court considers real estate, savings, investments, business interests, and debts or loans burdening the assets.
  • 3-year limitation — you have 3 years from the date of the divorce order to commence a property division claim in the Family Court.

Child Custody and Parental Responsibility

When children are involved, the Family Court's primary concern is the best interests of the child. Parental responsibility covers upbringing, education, healthcare, travel decisions, and contact arrangements.

Types of Custody in Cyprus

  • Joint custody — both parents share custody, even after separation or divorce. The court determines the child's primary residence and the other parent's contact arrangements.
  • Shared custody — similar to joint custody, but with arrangements for the child to spend roughly equal time with each parent.
  • Sole custody — awarded when one parent is deemed unable to provide adequate care, or when circumstances require a single decision-maker. The non-custodial parent typically retains contact rights, including overnight stays.

How Custody Decisions Are Made

If parents cannot agree, the Family Court decides based on the child's emotional, educational, and psychological needs. The court may consider the child's own wishes, depending on their age and maturity. The Social Welfare Services are often involved to assess the family situation and provide recommendations to the court.

In many cases, parents reach a mutual agreement, which the court formalises in a consent order.

Child Maintenance

The parent who does not have primary custody is typically required to contribute to the child's financial support. Maintenance amounts are determined by the Family Court based on the child's needs, the paying parent's income and financial circumstances, and the standard of living the child enjoyed during the marriage.
