The 2023 Civil Procedure Rules

Cyprus reformed its civil procedure on 1 September 2023 with a new set of rules modelled on the English Civil Procedure Rules. The reform introduced an overriding objective, active case management by the court, and pre action protocols that require the parties to exchange information before a case is filed. A claim now begins with a claim form and particulars of claim, and strict deadlines apply for the memorandum of appearance and the defence. Commercial and Civil Disputes We Handle

Interim Remedies and Injunctions

In urgent cases, the outcome often depends on getting the right order quickly. Cyprus courts can grant powerful interim remedies, including freezing (Mareva) injunctions and disclosure orders, sometimes without notice to the other side, where the applicant shows a serious issue to be tried and that the balance of convenience favours the order. Arbitration, Mediation and Enforcement

Litigation is not the only route. We represent clients in arbitration and in mediation under the Mediation Law, which can resolve a dispute faster and more privately than a court hearing. When you hold a judgment, whether from Cyprus or abroad, we enforce it against the other party's assets, including through recognition of foreign judgments under the Brussels Regulation for European Union member states. Frequently Asked Questions

The duration varies significantly depending on the complexity of the case and the court’s workload. Simple cases before the District Court may be resolved in 6-12 months, while complex commercial disputes can take 2-4 years. Appeals to the Supreme Court add an additional 1-2 years.
Litigation costs include legal fees, court filing fees, and potential expert witness fees. Cyprus follows the ‘loser pays’ principle, meaning the unsuccessful party is generally ordered to pay a contribution towards the successful party’s legal costs. Mediation is not mandatory in Cyprus, but courts increasingly encourage parties to attempt mediation before proceeding to trial. Cyprus has enacted the Mediation in Civil Disputes Law (Law 159(I)/2012) which provides a framework for mediation. We recommend considering mediation as it can resolve disputes faster and more cost-effectively than litigation.
