A Cyprus will must satisfy the Wills and Succession Law, Cap. 195 and fit the testator's family and cross-border circumstances. A template cannot verify capacity, formal execution, the disposable share or the law governing an international succession.
The testator must be at least 18 and have testamentary capacity. The will must be signed or acknowledged in the simultaneous presence of at least two witnesses, who then sign as the law requires.
A beneficiary remains competent to witness, but a gift to an attesting witness—or to that witness's spouse or child—is void to that extent. Independent witnesses should therefore be used. An executor is not disqualified merely because of the office.
Where Cyprus succession law applies, section 41 limits the freely disposable share. It is generally one quarter where a child or descendant survives, one half where there is no descendant but a spouse or parent survives, and the whole estate where none survives. The calculation and persons entitled must be checked on the actual family tree and estate.
Under Regulation (EU) 650/2012 the default applicable law is generally the law of habitual residence at death. A person may expressly choose the law of a state whose nationality they possess. This is not a free choice of any country's law and should be coordinated across all wills.
Marriage can revoke a will under section 38 subject to the statutory exception. A will can also be revoked by a later valid will or other method recognised by law. Review it after marriage, divorce, birth, death, relocation, a major asset change or a change in tax residence.
